Welcome to Buyer Nexus (“Company”, “we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website, applications, APIs, and services (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Eligibility

To use the Platform you must be at least 18 years old and legally capable of entering into binding agreements. By using the Platform you represent and warrant that the information you provide is accurate, current, and complete.

2. Accounts and Registration

• To access certain services you must register and create an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access to your account.

3. Services Provided

Buyer Nexus provides CRM, business automation tools, messaging APIs, and related services. Features, functionality, and availability may change from time to time. We may update or modify services without prior notice.

4. Acceptable Use

You agree not to use the Platform for any unlawful, abusive, or fraudulent activities, including but not limited to:

• Sending spam, unsolicited marketing, or content that violates WhatsApp/Meta policies.
• Uploading malware, viruses, or harmful code.
• Interfering with or disrupting the security, performance, or availability of the Platform.

We reserve the right to suspend or terminate accounts that violate these rules.

5. Fees and Payments

• Certain services may require payment. Fees will be disclosed before purchase.
• All fees are non-refundable unless otherwise required by law or explicitly stated.
• You are responsible for applicable taxes associated with purchases.

6. Intellectual Property

All content, trademarks, logos, and materials on the Platform are the property of Buyer Nexus or our licensors. You may not copy, modify, distribute, or create derivative works without our prior written permission.

7. Third-Party Services

The Platform may integrate with third-party services (for example: WhatsApp/Meta, payment providers). Your use of those services is subject to their terms and policies. We are not responsible for third-party services, and any disputes with third parties must be resolved directly with them.

8. Data and Privacy

By using our services you consent to our collection and use of your data as described in our Privacy Policy. If you use Buyer Nexus to send messages via WhatsApp, you must obtain any required consents and comply with applicable messaging and privacy laws.

9. Disclaimers

The Platform is provided “as-is” and “as-available” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted service or fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Buyer Nexus shall not be liable for indirect, incidental, special, or consequential damages. Our aggregate liability for claims related to the Platform shall not exceed the amount you paid to Buyer Nexus in the three (3) months prior to the claim arising (or ₹1,000 if you have not paid any fees).

11. Termination

We may suspend or terminate your account and access to the Platform if you breach these Terms or if required by law. You may stop using our services at any time. Upon termination, we will handle data in accordance with our Privacy Policy and any DPA in place.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India, unless otherwise required by mandatory law.

13. Changes to These Terms

We may update these Terms periodically. We will post the revised Terms on this page and, for material changes, provide notice to account administrators. Continued use after posting constitutes acceptance of the updated Terms.
